LIMITED WARRANTY 30-DAYS
FOMENTEK WARRANTS ALL PRODUCTS AGAINST DEFECTS IN MATERIAL OR WORKMANSHIP AS FOLLOWS:
Subject to the terms and conditions set forth in this warranty (this “Warranty”), Polar Fusion LLC, dba Fomentek (“Fomentek”) warrants all Fomentek products (the “Products”) for the stated period of time from defects in materials or workmanship (a “Defect”), to the original owner of the Product, and for the activities for which the Products are intended.
Fomentek products are warranted for a period (the “Warranty Period”) of 30 days from the date of purchase. This Warranty does not cover cosmetic flaws from shipping or manufacturing or damage caused beyond the control of Tiger Tail such as acts of God, accident, negligence, abuse, theft, misuse, normal wear and tear, or modification of, or to, any part of the Product. This Warranty does not cover damage due to improper care, maintenance or operation, or attempted repair by anyone other than the Fomentek warranty service center. This Warranty does not cover Products expressly sold “AS IS,” or Products sold with any other express warranty disclaimers. This Warranty is in lieu of all other express warranties which may have been communicated to you, whether orally or in writing.
THE PRODUCT REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS YOUR EXCLUSIVE REMEDY. FOMENTEK SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON THIS PRODUCT. EXCEPT AS SPECIFICALLY PROVIDED IN THIS WARRANTY, FOMENTEK MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This Warranty gives you specific legal rights, and you may have other rights, which vary from state to state. If it is determined by a court of competent jurisdiction that a certain provision of this Warranty does not apply, such determination shall not affect any other provision of this Warranty and all other provisions shall remain in effect. This Warranty is only valid in the United States.
Warranty Procedure
To obtain Product repair or replacement pursuant to this Warranty, you must return the Product to the Fomentek warranty service center (address below) in its original packaging or in secure packaging with an equal degree of protection, along with the proof of purchase in the form of a bill of sale or receipted invoice which evidences the Product is within the Warranty Period. Also required is a packing list which includes your name, daytime telephone number, and return street address. PO boxes are not acceptable due to the shipping and package tracking services used. Please include on the packing list a brief description of the warranty issue. Mail products to: Fomentek Warranty Service Center, 8504 S 228th St., Kent, WA 98031. Fomentek recommends shipping your package with a delivery company that offers a tracking service. Fomentek is not responsible for your Product until it is received by Fomentek warranty service center. Tiger Tail is not liable for any product lost in shipping on the way to our warranty service center.
Upon receipt of a Product for repair or replacement, Fomentek Warranty Service Center will inspect it and determine if the Product falls within this Warranty. If your Product fails due to a Defect during the Warranty Period, as solely determined by Fomentek, this Warranty will apply and Fomentek’s first option will be to replace the Product, free of charge, and return it to you with freight prepaid.
Repairs not covered by this Warranty, or repairs requested after the Warranty Period has expired may be completed by Fomentek at your expense. Fomentek will communicate with you if the necessary repairs are not covered by the Warranty, or if the Warranty Period has expired. If this Warranty is not applicable, you can elect to have Fomentek repair or return the Product. The cost of the repair and the return freight are both your responsibility.
